Terms & Conditions
Welcome to Ludwig's Original Tours ("LOT," "we," "us," or "our"). By booking a tour or activity through our website (ludwigsoriginaltours.com), you ("you," "your," or "the customer") agree to be bound by the following Terms and Conditions. Please read them carefully before making a booking.
1. Booking and Payment
1.1. All bookings made through our website are subject to availability and acceptance by LOT. A booking is confirmed only upon receipt of full payment and issuance of a confirmation email from our booking platform, Bokun.
1.2. Prices are listed in Euros (€) and include applicable taxes unless otherwise stated. Payments are processed securely through Stripe.
1.3. By completing a booking, you confirm that you are at least 18 years of age or have the consent of a parent or guardian, and that you meet any minimum age requirements specified for the activity (e.g., 21 for certain pub crawls).
2. Punctuality and Attendance
2.1. You must arrive at the designated meeting point at least 15 minutes before the scheduled start time of the activity. If you arrive more than 15 minutes late without prior notification to LOT, your ticket will be deemed invalid, and you will not be permitted to join the activity. No refunds or rescheduling will be offered in such cases.
2.2. Prior notification of delay must be communicated to LOT via email (hello@ludwigsoriginaltours.com).
3. Cancellation Policy
3.1. Customer Cancellations: You may cancel your booking and receive a 100% refund if the cancellation is made at least 24 hours before the scheduled start time of the activity. Cancellations must be submitted in writing via email to hello@ludwigsoriginaltours.com.
3.2. Refunds for cancellations made less than 24 hours before the activity start time will not be issued, except in cases of force majeure (e.g., serious illness or natural disasters), subject to LOT's discretion and provision of verifiable documentation.
3.3. LOT Cancellations: In the unlikely event that LOT cancels an activity due to insufficient participants, extreme weather, or other unforeseen circumstances, you will be offered a full refund or the option to reschedule to another available date.
4. Conduct, Safety, and Zero-Tolerance Policy
4.1. Respect and Behavior: All participants must treat LOT’s guides, staff, other participants, and third parties with respect at all times. LOT maintains a zero-tolerance policy toward any form of harassment, discrimination, aggressive behavior, unwanted physical contact, sexual comments, stalking, or any conduct that makes others feel unsafe.
4.2. Immediate Removal and Bans: LOT reserves the right to refuse participation, remove any participant from an activity, or end the activity early if a participant’s behavior is, in the sole judgment of the guide or LOT staff, unsafe, inappropriate, threatening, or disruptive. This includes (but is not limited to) sexual harassment, assault, excessive intoxication, refusal to follow instructions, or behavior that may endanger others. No refunds will be issued in such cases, and LOT may impose a permanent ban on future bookings.
4.3. Authority to Seek Assistance: Guides may involve venue security, law enforcement, or emergency services at their discretion if a participant’s behavior poses a safety risk. LOT reserves the right to cooperate fully with authorities, including providing booking information when required by law.
4.4. Guide Safety: To ensure the safety of LOT guides, LOT may modify, cancel, or decline a tour if group size or guest behavior creates an unsafe environment. Guides have full discretion to determine whether it is safe to continue a tour.
4.5. Venue and Third-Party Compliance: Participants must comply with the rules of all venues visited during an activity and follow any instructions given by venue staff or security personnel. Failure to comply may result in removal from the activity without refund.
4.6. Alcohol Consumption: For activities involving alcohol, you agree to consume responsibly. LOT is not liable for incidents arising from excessive alcohol use or behavior influenced by intoxication.
5. Safety & Incident Reporting
5.1. Participants may report any safety concern or misconduct to LOT at any time.
5.2. LOT will investigate any reported incident and take appropriate action, including bans or cooperation with authorities.
5.3. LOT may create internal incident reports for safety and legal compliance.
6. Liability
6.1. LOT is not liable for any personal injury, loss, or damage to personal property during an activity, except where such injury or loss is directly caused by LOT's gross negligence or willful misconduct.
6.2. LOT is not responsible for any third-party services (e.g., venues visited during pub crawls or bike rentals) and any issues arising from such services should be addressed directly with the third party.
6.3. You acknowledge that participation in certain activities (e.g., pub crawls, bike tours) carries inherent risks, and you participate at your own risk.
7. Intellectual Property
7.1. All content on our website, including text, images, and logos, is the property of LOT or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or use such content without prior written permission from LOT.
7.2. Photos or videos taken by LOT staff during activities may be used for promotional purposes. By participating, you consent to such use unless you explicitly opt out in writing at the time of booking.
8. Privacy
8.1. LOT collects and processes personal data in accordance with our Privacy Policy, available at ludwigsoriginaltours.com/privacy-policy. By booking, you consent to the collection and use of your personal information as outlined therein.
9. Complaints and Customer Support
9.1. If you have any concerns, complaints, or feedback regarding your experience or booking, please contact LOT at hello@ludwigsoriginaltours.com.
9.2. LOT aims to acknowledge all complaints within 5 business days and provide a full response within 14 business days.
9.3. LOT will make reasonable efforts to resolve complaints amicably and efficiently.
10. Governing Law and Dispute Resolution
10.1. These Terms and Conditions are governed by the laws of the Netherlands. Any disputes arising from or related to these terms shall be subject to the exclusive jurisdiction of the courts of Amsterdam, Netherlands.
10.2. In the event of a dispute, you agree to attempt to resolve the matter amicably with LOT before pursuing legal action.
11. Amendments
11.1. LOT reserves the right to amend these Terms and Conditions at any time. The version in effect at the time of your booking will apply to your booking.
